Terms of Use

These terms set the ground rules for using Breathable and explain the limits of this gentle wellness tool.

Agreement to these terms

These Terms of Use (“Terms”) are an agreement between you and Uriel Bitton, operator of Breathable (“Breathable,” “we,” “us,” or “our”). By downloading, accessing, or using the Breathable iOS app (the “App”), you agree to these Terms.

If you do not agree, do not use the App. If you use the App for a minor, you confirm that you are authorized to accept these Terms for them and will supervise their use as appropriate.

Apple’s Standard EULA

The App is licensed through Apple’s App Store under Apple’s Standard Licensed Application End User License Agreement (“Standard EULA”). These Terms supplement the Standard EULA and are not intended to replace it with a custom EULA. If these Terms conflict with the Standard EULA, the Standard EULA controls to the extent applicable.

A wellness tool, not medical care

Breathable provides general breathing guidance for relaxation and everyday wellness. It does not provide medical advice, diagnosis, treatment, psychotherapy, crisis support, or emergency services. It is not a substitute for a qualified medical or mental-health professional, and no particular result is promised.

  • Consult a qualified professional before using breathing exercises if you have a health condition or concern about whether they are appropriate for you.
  • Stop the exercise and seek appropriate help if you feel dizzy, faint, short of breath, in pain, or otherwise unwell.
  • Do not use the App while driving, operating machinery, or in any situation where distraction or altered breathing could create a risk.
  • If you believe you are experiencing a medical or mental-health emergency, contact local emergency services or an appropriate crisis service immediately.

License and acceptable use

Subject to these Terms and the Standard EULA, you may use the App for your personal, non-commercial wellness purposes. You must comply with applicable laws and may not:

  • Use the App in a way that harms another person or violates their rights.
  • Interfere with, disrupt, bypass, or attempt to defeat the App’s operation or security.
  • Copy, modify, distribute, sell, sublicense, reverse engineer, or derive source code from the App except where applicable law expressly permits it.
  • Use Breathable’s name, artwork, companions, or other content to imply endorsement or create a competing product without permission.

Price and purchases

Breathable is currently provided as a free App and does not offer subscriptions or in-app purchases. Downloading and distribution are handled by Apple under your App Store agreement with Apple. If Breathable introduces paid features in the future, applicable terms and required purchase information will be presented before you buy them.

Ownership

The App and its software, visual design, text, companion characters, illustrations, branding, and other content are owned by or licensed to Breathable and are protected by intellectual-property laws. Except for the limited right to use the App under these Terms and the Standard EULA, no rights are transferred to you.

Availability, updates, and ending use

We may maintain, update, change, suspend, or discontinue all or part of the App. Features may vary by device, iOS version, region, or App version. We do not promise that the App will always be available, uninterrupted, or error-free.

You may stop using the App at any time by deleting it. Your right to use the App may end if you materially violate these Terms or the Standard EULA. Provisions that by their nature should continue—including ownership, disclaimers, and liability limitations—will survive.

Privacy

The App is designed to keep sessions and preferences on your device without an account. Our Privacy Policy explains how the App handles information and is incorporated into these Terms by reference.

Disclaimers

To the fullest extent permitted by law, the App is provided “as is” and “as available,” without warranties beyond those that cannot legally be excluded. We do not warrant that breathing guidance will be suitable for every person or situation, achieve a particular wellness outcome, or operate without interruption or error.

Nothing in these Terms excludes warranties, guarantees, or other consumer rights that cannot be excluded under applicable law. Warranty obligations relating to an App Store license are also addressed in the Standard EULA.

Limitation of liability

To the fullest extent permitted by law, Breathable and its operator will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of or inability to use the App. Breathable is not responsible for decisions made in reliance on the App as medical or professional advice.

These limitations do not apply where liability cannot legally be limited or excluded, including any rights you may have under mandatory consumer-protection law.

Changes to these terms

We may update these Terms when the App or applicable requirements change. The revised Terms will be published at this URL with a new effective date. If a material change requires additional notice or consent, we will provide it as required before the change takes effect.
